1. Acceptance of Terms

By creating an account, subscribing, or using the Service, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Description of Service

GPT KeFu provides an AI-powered auto-reply platform for customer support channels such as Crisp and Telegram. The Service ingests your knowledge base and conversation data, sends selected content to third-party large language model ("LLM") providers, and generates suggested replies or automated responses according to your configuration.

3. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions, Billing, and Auto-Renewal

Some features require a paid subscription. When you subscribe, you authorize us to charge the applicable recurring fee using your selected payment method or your wallet balance. Subscriptions automatically renew for the same billing period unless you cancel before the renewal date. You are responsible for ensuring sufficient wallet balance or valid payment credentials.

• Cancellation — You may cancel auto-renewal at any time by contacting us at [email protected] or through the Telegram channel listed on our website. We will process your request within two business days and confirm the cancellation. Cancellation takes effect at the end of your current billing period, and you will retain access until that date. We do not prorate unused time unless required by law.
• Price changes — If we change subscription prices, we will notify you in advance. Continued use after the change takes effect constitutes acceptance.
• Refunds — Fees are non-refundable except where required by applicable law. If you believe you were charged in error, contact us within 30 days of the charge.
• Cryptocurrency payments — Wallet deposits made by cryptocurrency (such as Polygon or TRC20 transfers) are final and non-reversible. Blockchain transactions cannot be reversed, and refunds are not available except where required by law. Deposited funds are stored as wallet balance and consumed for subscriptions or usage charges.
• Failed payments — If a renewal charge fails, we may suspend access until payment is successfully processed.

5. Acceptable Use

You agree not to use the Service to: (a) violate any applicable law or regulation; (b) infringe intellectual property, privacy, or other rights; (c) send spam, scams, malware, hate speech, harassment, or abusive content; (d) interfere with or disrupt the Service or underlying networks; (e) attempt to gain unauthorized access; or (f) process personal data of end users without a lawful basis and adequate notices.

6. User Content and Data Rights

You retain ownership of the content you upload to the Service, including your knowledge base, FAQs, and end-customer conversation data. You grant us a limited license to host, process, and transmit that content solely to operate and improve the Service for you.

You represent and warrant that: (a) you have all necessary rights, consents, and lawful bases to upload your knowledge base and to process end-customer conversations through the Service; (b) your content does not violate any law or third-party rights; and (c) you have provided appropriate privacy notices to your end customers where required.

We do not use your content to train or improve general-purpose AI models unless you separately opt in. Our AI subprocessors are contractually restricted from retaining or using your content for any purpose other than generating responses for your account.

7. AI Output Disclaimer

The Service uses third-party LLMs to generate replies. AI outputs may be inaccurate, incomplete, outdated, or inappropriate and are not a substitute for professional advice, including legal, medical, financial, or other regulated advice.

You are responsible for configuring the Service in a way that matches your risk tolerance and support workflow. This includes choosing when the AI operates automatically, when it provides draft suggestions for review, and when it escalates to a human agent. You should implement sampling, monitoring, and human handoff procedures appropriate for your use case. For high-risk or regulated topics, you must enable human review before any AI-generated content reaches your end customers.

We are not liable for any reliance on or consequences of AI-generated outputs sent through your channels.

8. Intellectual Property

All software, designs, text, graphics, and other materials provided by GPT KeFu are owned by us or our licensors and are protected by intellectual property laws. You receive no ownership rights in the Service beyond the limited right to use it under these Terms.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access for violations of these Terms, non-payment, or other material breaches. Upon termination, your right to access the Service ceases immediately. Certain provisions, including payment obligations, data retention, and limitation of liability, survive termination.

10. Indemnification

You agree to indemnify and hold harmless GPT KeFu and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the Service, your content, or your violation of these Terms or any third-party rights.

11. Limitation of Liability

To the fullest extent permitted by law, GPT KeFu shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim, or $100 if no payment was made.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in San Francisco County, California, and you consent to the personal jurisdiction of those courts.

13. Electronic Acceptance

By registering for an account, subscribing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. You should retain a copy of these Terms for your records. If you do not agree, you must not use the Service.

14. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We may modify these Terms from time to time. Material changes will be posted on the Service with an updated "Last updated" date. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
